Andrew Rosenthal, Carla Robbins, David Shipley, Robert Semple, Serge Schmemann, Philip Boffey, Lincoln Caplan, Francis Clines, Lawrence Downes, David Firestone, Carol Giacomo, Verlyn Klinkenborg, Eduardo Porter, Eleanor Randolph, Dorothy Samuels, Brent Staples, David Unger, Teresa Tritch, Bill Keller, and unknown others did knowingly publish classified diplomatic cables unlawfully obtained from foreign agents in flagrant violation of the Espionage Act.

That some of these cables concern the nuclear weapons programs of rogue states satisfies the statutory requirement for seeking the death penalty as laid out in 18 U.S.C. § 794.

President Obama, as chief executive of the United States government, your duty is clear.

1) Only two words into the statue you've already fucked up:

Journalist's intent is not to cause injury, but to do their job and report the truth.

2) The journalists are not the ones transmitting the info. Only the original leaker and wikileaks are guilty of that. The rest of us simply saying that Wikileaks is there -- at this address -- are simply referring to information that is already in the public. You can't transmit a secret that's already been made public.

The administration is considering prosecuting Assange. But what is the difference between Assange and the New York Times? Why prosecute one but not the other? They both had unauthorized access to classified information and they both communicated the information to others to the detriment of U.S. national security. The New York Times will invoke the First Amendment, but the Supreme Court ruled 91 years ago that the press is not free to disclose classified information, despite current practice. There does not seem to be a convincing reason in principle not to prosecute the Times for espionage and treason.

The meaning of 794 is about transmitting military secrets one person to another to the injury of the US. To ensure the law is not too narrow the text obviously includes various alternative broader disclosures. Further broadening this definition to include "the press disclosing to the public" creates ample bases for legal interpretation. Such interpretation is probably beyond the skill of lay persons. Further, is this really to the injury of the US? This is also open to interpretation. Also, like any law, there are minimum and maximum penalties depending on the degree of the offense. A sentance of death would be draconian and unfair in this case.

For instance it does not compare to John-the-snitch posing as an naval officer and selling stolen passwords to communist korea in exchange for 40 lbs of pure coke.

It's best never to suggest the death penalty unless you yourself are willing to administer the injection. For John-the-snitch you may have no problem, but these other people???
