Nick Berg's Killing: 50 Fishy Circumstances, Contradictory Claims, and Videotape Anomalies

The video tape and circumstances of the killing of Nick Berg seem fishier and fishier.

This article summarizes and lists 50 anomalies around Berg and his death.


Summary

A large number of anomalies surround the life and death of Nicholas Berg. A Jewish man, 26 years of age and a U.S. Citizen, he traveled alone in Iraq. Family and friends described Berg as an adventurer, high spirited and intelligent. A Washington Post report notes, "Berg was a weight lifting enthusiast and amateur comedian who had traveled abroad to help people improve their lives. Among his trips was a visit to the West African country of Ghana, where he taught villagers to make bricks and returned emaciated because he gave away most of his food."

Berg visited Iraq from December, 2003, to January, 2004, and then again starting March 14, 2004. Berg was purportedly looking for electrical contracting work building radio towers. He could not find work, though there was reportedly plenty.

On March 24, Iraqi officials arrested Berg at a checkpoint in Mosul and jailed him, because of his Jewish last name and the Israeli stamp in his passport. (See Washington Post report - reg req'd - or CSM Terrorism & Security update for May 13, which excerpts stories about Berg from various media.) Berg told friends in Baghdad that the Israelis thought he might be a spy. (See Telegraph article, "Beheaded American was arrested as a spy because of his Jewish name.") On April 05, 2004, the Bergs filed suit in federal court in Philadelphia, contending that their son was being held illegally by the U.S. military in Iraq. The next day, April 6, Nick Berg was released. On Saturday, May 8, Berg's body was found outside of Baghdad on a highway overpass. On May 11, 2004, a video of Nick Berg's execution, seemingly by beheading, was posted on the Muntada al-Ansar website, which is now offline.

There are conflicting reports about Berg's whereabouts in Iraq. According to an email to the Berg family from Beth A. Payne, a U.S. consular officer in Iraq, the U.S. military were holding Berg. This was apparently for 13 days. Iraqi police denied holding Berg. In contrast, the Telegraph article above notes, "Dan Senor, spokesman for the US-led coalition in Iraq, insisted Mr. Berg was arrested and held by Iraqi police." The timeline of Berg's captivity and the timing of the release of the video are suspicious. If Payne was correct, why did the U.S. military hold Nick Berg for two weeks? Why did the U.S. military deny this?

The video of the killing has many flaws including problems with time skips, audio dubbing, and the characteristics, appearance and speech of Berg and the killers. People from Middle Eastern cultures believe that Middle Eastern people were not involved in this video, based on the mannerisms, accents, behavior and appearance of the killers. A close inspection of the video suggests that Westerners may have been involved.

For a number of reasons, it does not appear that the Jordanian terrorist Abu Masab Al-Zaraqawi, who was voice identified by the CIA (and whose name was on the tape), was involved. He has a poorly functioning prosthetic leg and a hand tattoo, which should have been observed. Neither were. The accent of the speaker in the video was not Jordanian. Why has the CIA seemingly lied about the analysis of Al-Zarqawi's voice and his role in the killing?

Considering the many discrepancies and contradictions noted below, it seems possible that the Berg killing is a poorly crafted psy-ops exercise. This video was possibly constructed by U.S. operatives to impact the extremely volatile political developments in the U.S. and the international condemnation around the Abu Ghraib torture photos. The torture photos are mentioned in the speech in the video, though Berg may have been killed before the photos were circulated.

The majority of the points below are summarized and excerpted from eight summary articles that culled points from news articles and blog posts. (See links at end.) I compared, combined and edited the various points. Further, I added more points based on my viewing of the video (see Wizbang! Blog: Berg video site list) and by reviewing various news articles. I also added a few points based on comments at kuro5hin.org.

Some of the points below are compelling. Some are weak or may turn out to be insignificant or coincidental. This is a work in progress, an early overview of discrepancies. There are too many discrepancies and contradictions to dismiss doubts about the video and the official U.S. stories about Berg. Additional inquiry and fact checking are needed as the Berg story unfolds or, rather, unravels.

Suspicious Circumstances and Timeline

1) A Jewish man and U.S. citizen traveling alone in Iraq?
Why did a private Jewish American citizen choose to wander around Iraq by himself? He also had a passport stamp from Israel - very unsafe to travel with.

2) Berg wanted to return home
In his last email on April 6 to his family, Berg stated he wished to return home as soon as possible. The FBI claim he refused an offer of help to get home (perhaps because of danger to get to airport).

3) Three FBI visits
The FBI made three visits to the Berg while he was in custody in Iraq. This suggest U.S. authorities were concerned about more than Berg's well-being. They may have had their own suspicions about what the young American was doing in Iraq.

4) FreeRepublic website listed the Berg business as an "Enemy of the State".
Nick Berg's father, Michael Berg, signed an anti-war petition online and included the business name. (Note that Nick Berg himself was pro-Bush and pro-war.) This occurred a week before his son's second departure to Iraq. As a result of this statement the Berg business was put on a right wing enemies list. The FreeRepublic website listed the Berg business as an "Enemy of the State." This may have been linked to the thre visits by the FBI during Nick Berg's containment by the Iraqi Police and then presumably by (or under supervision) of the US Military.

5) Family sues in U.S. and Berg released next day in Iraq
On 5 April, Berg's family filed a suit in federal court in Philadelphia - contending that their son was being held illegally by the US military in Iraq. The next day he was released and left to get himself home.

6) U.S. custody
Berg's last known whereabouts was in U.S. custody. On April 1, Beth A. Payne, the U.S. consular officer in Iraq, sent an e-mail to the family of Nick Berg. It stated that Ms. Payne had located Nick, and he was currently in custody of the US military. She wrote, "I have confirmed that your son, Nick, is being detained by the U.S. military in Mosul. He is safe. He was picked up approximately one week ago. We will try to obtain additional information regarding his detention and a contact person you can communicate with directly." 7) Denial of custody
The US military has stated that Berg was never in US custody and that he had been in custody of the Iraqi police. The Iraqi police adamantly deny he was ever in their custody. (See again: The Unanswered Questions of Nick Berg's Murder.) If this is so, we have to conclude that either the email from Ms. Payne was incorrect or that the US military has been lying.

8) Apprehension of Berg
Berg was mysteriously captured while still wearing jumpsuit. Either he escaped from U.S. captors or U.S. let him out -- with orange suit and all -- to be immediately apprehended by "terrorists" (before he had a chance to change). Or, the captors somehow came across a U.S. military prison jumpsuit. (More on this is below.) This scenario contradicts the following:

9) Was Berg at hotel several days to April 10?
Staff at Al-Fanar Hotel in Baghdad apparently told The Associated Press that Berg stayed there for several days until April 10. A U.S. consul contract worker checked at the hotel on 4/14 and staff there did not remember Berg.

10) Family blames detainment by U.S. military for Berg's death
The last time the family heard from Nick Berg was on 9 April. He had planned to return home at the end of March. His headless body was found near Mosul on 8 May. "That's really what cost my son his life, the fact that the United States government saw fit to keep him in custody for 13 days without any of his due process or civil rights," Michael Berg said.

Timing of Killing and Videotape Release

11) Berg is killed before torture photos released but video tape refers to photos?
To quote "Fishy Circumstances and Flawed Timelines Surround American's Beheading)":
"me and a friend were discussing recent news events and trying to piece together the information presented to us, thought you might want to look into this further, they said in the news that Nicholas Berg was killed 2 weeks ago (i think), however in the video the culprits who killed him said they were "avenging iraqi prisoner abuse" but those photos weren't released until last week, so my question is how is that even a possible motive if he was killed prior to the abuse photos being released?? maybe i am misinformed but thought id ask the question to someone who would look into it."

12) Text with video mentions "shameful pictures"
The text posted to the website along with the video the translation of the Arabic statement, cites "shameful pictures." Here is a translation of the Arabic statement (at the Northeast Intelligence Network) made with the video: "And the shameful pictures and the news of the evil humiliation of the Islam people men and women in Ghareb 's father prison then where the jealousy and where the zeal and where the anger about the Allah's religion and where the jealousy for the Muslims sanctities and where the revenge for the honors of Muslims and Muslims is in the crosses prisons."

13) Wag the dog timing
There is extremely convenient 'wag the dog' timing at the height of furor regarding U.S. torture of Iraqis.

14) Torture photo timing
CNN poll question: 'Is the Berg killing a reason for withholding any remaining Iraq prisoner abuse pictures?' Bush has been reported to be struggling with question of whether the Pentagon should release additional torture photos. Given that the alleged decapitation of Berg was allegedly prompted by the first wave of torture photos, Bush could now cite 'national security' issues for withholding additional materials.

Videotape of Berg, His Decapitation, and Location

15) Orange jumpsuit
Berg shown in video wearing orange jumpsuit known to be of U.S. issue. The orange jump suit "appears" to be identical to the jumpsuits used at Guantanamo. (Compare with pictures at Guantanamo.) The orange jumpsuit was standard US military issue to men in custody. It is unlikely Berg would continue wearing a U.S. custodial uniform if he had been released by the military as they claim. The fact he was still wearing the suit is both anomalous and suggestive. One wonders: Was there an immediate transfer of Berg from the US military to unknown persons, preventing Berg from discarding his US prison garb?

16) No blood at decapitation
When Berg is decapitated, there was almost no blood. If Berg were still alive at this point, with the cut starting at front of throat, blood would have been spraying everywhere. Berg's severed head, the floor, Berg's clothes, and even the hand of the 'Arab' who decapitated Berg had no visible blood on it. When the executioner holds up Berg's head immediately following what is represented as an actual decapitation of a living person, there is no significant blood flow from the neck or blood splatters showing anywhere on the executioner.

17) Berg did not move
Berg seems limp just before the beheading. It is not clear if he was moving after the time skip in the tape. While on the ground, Berg's body didn't seem move except in response to the captors movements. Although held down, Berg would have tried to instinctively wiggle and writhe away from captor's grip and use of a knife. (That is unless he was long dead after the cut in the tape.) A surgeon would very likely testify that the beheading did not cause the death.

18) Berg may have been dead just before beheading
The lack of spurting blood and lack of movement suggests Berg was already dead at the time of the alleged decapitation. During the beheading, Berg's eyes are not seen. Camera angle made it impossible to see if Berg's eyes were open or glassy. Berg very probably was killed before the staged beheading. Did the captors have no stomach for the beheading of a living person?

19) Straight cut on the neck
The cut on Berg's neck seems to be too straight to have been done crudely and with such speed by a man wielding a large knife. Anybody who has carved a turkey knows there is something wrong with the supposed beheading. The suspended head looks more like Berg had been neatly beheaded by a guillotine.

20) Is the person in the video Berg?
Some viewers believe the person in the video only vaguely resembles Berg. (Note: presumably the family can and will identify Berg's voice and appearance.)

21) Chair
The chair that Berg was seated in during the filming was the exact same kind as seen in a color photo taken at the Abu Ghraib Prison. One blog mentioned this was "a standard issue military chair." However, these chairs might be abundant in Iraq. (See photo comparisons at link in next point.)

22) Walls and baseboard at the killing site same color as some in Abu Ghraid prison
However, many walls may be similar in Iraq. To quote Marc Perkel (It's The Same Chair!!!! OMFG!!):
"I have some more pics but the walls are the same yellow color and the baseboard is the same color as Abu Ghraib prison."

More Videotape Anomalies

23) The videotape was quite blurred.

24) A quickly disappearing video source?
A Reuters journalist in Dubai first named the Muntada al-Ansar al-Islami website as the source for the video - at www.al-ansar.biz. Although the site has now been shut down, Aljazeera.net had looked at the site within ninety minutes of the story breaking - and could find no such video footage. But Fox News, CNN and the BBC were all able to download the footage from the Arabic-only website and report the story within the hour.

25) Tape editing
The video tape is obviously spliced together and heavily edited: Going from a) Berg sitting in chair talking about family, to b) Berg sitting on floor with hooded "militants" behind, to c) blurry camera movement, to d) almost motionless Berg on floor as head cut off.

26) Long time jump in datestamp
There is a significant time jump on tape from a datestamp in the tape of about 2:44:40 to about 13:45:47. There could have been two cameras recording this event. However, there were changes in dress after the fact that would lead to the idea of an elapsed time.

27) Scream dubbed in: Screaming starts while Berg is not moving and before he is touched
Whatever the mismatch in the speaker and video (next point), videotape cognoscenti have said the scream was amateurishly dubbed into the tape. The writer of this K5 article reviewed this issue closely: The screaming starts (at 4:31 - on the copy I viewed, not the time stamp) about 5 to 6 seconds before Berg is touched (at 4:36) and he is moved to his side. He is just sitting there like a lump. While the screaming commences for (1 - 2 - 3 - 4 - 5 seconds), his head doesn't move and his mouth doesn't appear to move (though the tape is blurry), nor does he seem to be physically screaming at any time. Yet the audio plays a loud vigorous screaming. The exact same dubbed screaming continues after the long time jump and a bit of a time gap with silence and after some cutting on the head, during which Berg is not moving. This screaming seems clearly dubbed and is highly incongruous with Berg's lack of activity.

28) Handling of papers on video
"Terrorist" reader flips through pages of 'statement' at one point. He keeps ending up on the same page for awhile. As noted below, this would very likely produce a gap in speech, which is out of sync with the smooth timing of the spoken statement.

29) Audio is dubbed: Tape of speaker and video are out of sync
Audio experts note the tape is clearly dubbed. The speaker recording is different from executioner video recording, due to lag between audio and video.

"Analysis of Execution video -- I propose that the executioner's voice (according to my analysis of listening closely to the audio feed) is not that of the killer's. When listening to the executioner's voice on the tape one first notes that there is a 2-3 second lag in the "time" between audio and video, audio leading. This is consistent with the argument that the video camera and tape recorder are actually two different recording devices. What convinced me that the executioner could not be the "voice" behind the document, read prior to Nick Berg's execution, is the lack of consistency seen between the video and audio recordings, even if the 2-3 second delay is considered. A careful viewing of the video shows the executioner on "several occasions" fumbling with the 2 pages that he held, and at times reading the same page over again -- or so it appears. At least 4 times during the video the executioner is "turning over" pages, holding the pages "apart" as if confused, and all of this adds up to one conclusion. There should have been a "pause" or "2-3 second delay" in the reading of the documents during the physical handling of the documents -- but none is found that is long enough to account for it. Conclusion: The executioner is not "reading" the document. Someone else is. The executioner is trying his best to "lip sinc" the reading, but fails miserably on close inspection. The "smooth" reading of the document is entirely inconsistent (according my analysis of the video) and therefore cannot be the same person that is recording into the audio device."

30) Berg identification - why?
Berg goes to great trouble to identify himself, providing information about his family. Why? To elicit greater sympathy? Or to provide a positive ID. FBI visited Berg family in an attempt to 'verify his identity'. The guy in video looks little like Berg photos provided by family.

31) Woman's scream, instead of Berg?
The alleged scream on heard on the tape has been interpreted as a woman's scream by viewers. (The scream did not seem to this K5 article's author necessarily to be in a woman's voice.)

32) Mistranslation of Al Qaeda connection
On the first day of Nick Berg's execution, it was reported on several major news networks that al Qaeda was connected to the killer's statement, which turned out to be false. The US Intelligence translation still retains this "reference" to al Qaeda, which does not exist. The U.S. government translation of one statement made on the film is: "Does al Qaeda need any further excuses?" This is a falsification. The actual statement urged fellow insurgents to get off their hind ends and do something. One assumes the translator used by the US military is a native speaker of Arabic, so this may not be an innocent flub. Did the US government intentionally link an alleged al Qaeda group into the murder of Nick Berg? Note: the word on tape was al qaed, with quite a different meaning from al Qaeda.

Identity of Killers of Berg and Their Possessions

33) Western body posture and mannerisms of "terrorists"
The "terrorists" have Western-style body posture and mannerisms. They seem to be at parade rest at times.

34) "Terrorists" were fat
Several of the men in the film were fat by Iraqi standards. If they were Feyadeen or Mujahadeen, they probably have been living underground since the first days of the occupation. Tens of thousands of Iraqis have been shown on news stories as they have marched and demonstrated. One would be hard pressed to point out a single fat man among these thousands.

35) White hands of "terrorists"
Some of the "Arab terrorists" have pasty-white hands and (other exposed) skin. One would be hard pressed to find Arab men with pasty-white hands. (See: Nick Berg Conspiracy Theories Abound.)

36) Wrong accent
Al-Zarqawi is/was Jordinian. Arab linguists have said the man posing as Al-Zarqawi did not speak with a Jordanian dialect. Others have suggested the man reading the written statement may not have been a native speaker of Arabic.

37) Change in masks by beheader
To quote a K5 comment:
"The guy who holds up the head at the end has a white mask and no vest. The guy who pulls out the knife and starts cutting is in a black mask. The only guy with a white mask is wearing a green vest"

38) Voice id
Al-Zarqawi's identification by the CIA was based on "probable" voice id of the videotape.

39) Al-Zarqawi's missing leg
Al-Zarqawi was missing one leg. Al-Zarqawi allegedly wears a prosthetic device, according to previous CIA reports. (See: IHT Protrait of Al-Zarqawi.) There is no evidence that the killer wore a prosthetic device. Further, Al-Zarqawi had been outfitted with an artificial leg that did not fit or function properly. He was unable to walk or stand normally. No man in the group showed evidence of such infirmity.

40) Missing tattoos?
Large green tattooed "dots" are known to be on the back of Abu Musab Zarqawi's left hand. These tattoos cannot be seen in the close up video of the execution, though the back of his hand is fairly visible. (See: IHT Protrait of Al-Zarqawi.)

41) Al-Zarqawi dead?
Numerous indigenous sources have said Al-Zarqawi was killed by a US helicopter attack months ago when he was unable to move quickly enough to escape the targeted house. While others managed to exit the house in time to survive, he died in the collapsed building.

42) Gold ring on killer's hand
The man in the videotape who is purported to be Zarqawi seems to be wearing a gold ring. Note: This is a questionable point. To quote Healing Iraq (healingiraq.blogspot.com) as quoted at this angryfinger.org post (Nick Berg Conspiracy Theories Abound): "Islam does not specifically forbid that men wear gold, in fact the Quran and the Hadith have encouraged men to 'adorn' and 'embellish' themselves (dying hair, perfume, etc.) .... the practice of wearing gold ornaments is discouraged by Muslim clerics, "Gold is the ornament of women". Socially it is not acceptable in the Arab world for men to wear gold, although this has changed lately and many young men do (engagement and wedding rings are mostly gold)."

43) Why anonymous?
Al-Zarqawi's face is very well-known. If Al-Zarqawi was the perpetrator, why did he bother to cover it the whole time? If Al-Zarqawi is trying to build a resistance movement, why did he not uncover his face at some point? (If it was another terrorist impersonating Al-Zarqawi, why is the CIA identifying the voice as Al-Zarqawi's?)

44) Iraqi denial of "terrorists"
Iraqis who have seen the videotape on Arabic news broadcasts are universally saying the men in the film are not Iraqis. Are they saying this partly because the speaker does not employ an Iraqi dialect? Where does their certainty come from?

45) Firearms Israeli, not AK-47s
Firearms experts have stated the AK-47 carried by one man was a "Galil." This actually is an Israeli-made weapon that improves on the famous AK- 47. Feyadeen and other insurgents use AK-47s.

Berg's Activities and Return of the Body

46) Berg encountered Moussaoui, an al Qaeda operative, by chance in the U.S. in 1999
The FBI has reported (CNN, FOX) that Nick Berg's e-mail account was used by the "20th hijacker" of 9-11, Zacarious Moussaoui, whose computer held evidence of the 9-11 hijackers (and could not be searched by the FBI field office because of orders from Washington). The FBI interviewed Nick Berg about Moussaoui's use of his e-mail account to send "emails" but concluded that it was entirely "coincidental." Berg had apparently given the password to his e-mail account to an acquaintance of Moussaoui who he met on a bus in 1999 in Oklahoma. (See: Berg's encounter with 'terrorist' revealed.)

47) Berg's first visit to Iraq

"In the Seattle Post-Intelligencer (Seattle P-I), May 13, 2004, A4, appeared an AP article by Robert H. Reid entitled: "Questions over beheading victim's travel in Iraq." That article, which is not online, says: "Berg first worked in Iraq in December and January and returned in March. He was inspecting communications facilities, some of which were destroyed in the war or by looters. During his time in Iraq, he worked on a tower in Abu Ghraib, site of the prison where U.S. soldiers abused Iraqi inmates."
And from The Guardian [Questions Surround Slain American in Iraq] here is a similar reference:
Perhaps Nick saw too much when he was at the prison repairing the tower. And/or maybe that work required close collaboration with the military intelligence onsite so that he learned too much.
Also, today's NY Times article entitled: "General Took Guantanamo Rules To Iraq for Handling of Prisoners" by Tim Golden and Eric Schmitt says:
"When Major General Geoffrey D. Miller arrived in Iraq last August with a team of military police and intelligence specialists, the group was confronted by chaos."
"In one prison yard, a detainee was being held in a scorching hot shipping container as punishment, one member of the team recalled. An important communications antenna stood broken and unrepaired."

48) Work vs. no work?
It has been reported all week in the media that Nick Berg was "looking for business" for his small telecommunications business. Some of his friends in Iraq who were interviewed reportedly said "business was booming." Yet others said Nick was leaving because he "couldn't find any work."

49) Berg traveled at night
It has been reported by people who knew Nick in Iraq (interviews, major networks) that strangely enough, Nick "traveled" at night. Indeed, when Nick was initially picked up by Iraqi Police (checkpoint) he was held because of "suspicious activity."

50) Berg's family was not allowed to view the body of Berg on its arrival to the U.S.

17) Chair The chair that Berg was seated in during the filming was a standard issue military chair of the exact same kind as seen in a color photo taken at the Abu Ghraib Prison. The chances a terrorist cell would be using this same chair are minimal at best.
Those chairs also appear to be standard issue backyard furnature! We've had ones exactly like those for atleast 10 years out by the pool. This "evidence" needs to be a hell of a lot better than this to convince rationally thinking people.

There's a noticeable cut in the film at about 5:15 on my copy, just before they hold up the head. This may explain why the amputation is so clean -- the killers may have spent more time hacking away at the neck than the video shows.

I was also surprised at the lack of blood, but this may have been covered up by the dark floor. I am not a doctor, but I think if they made small cuts first, the blood pressure might have dropped so much that the blood wouldn't have sprayed but just gushed onto the floor.

Yet this would have meant he would have feinted from blood loss pretty quickly. One thing that really bugged me was how long he still kept saying "Oh my god" after having his neck cut. You'd think that with his jugular cut (presumably) he'd have feinted very quickly.

The man in the videotape who is purported to be Zarqawi is wearing a gold ring. This is absolutely proscribed by Islamic law. Note: This is a questionable point -- some Muslims wear gold.

That's why I love The Religion of Peace (tm). Holding someone hostage and making a video of them being decapitated is ok, but wearing a gold ring is strict no-no.

I've also in a news story elsewhere that Berg allowed an Arabic college acquitenance (sp?) to use his email address at one point, and that later the said person was investigated in connections to 911. That could perhaps explain it. I'm more inclined to say this is a coincidence.

Berg himself was also pro-war, in contrast to his father and had relatives (through marriage, not blood relatives I believe) in Northern Iraq - not too unlikely for a Jew, since Iraq did have a sizeable Jewish population (which was there since the biblical times  mostly fled around the time of Saddam's rise to power due to rampant pogroms). Visiting long-lost and isolated relatives may make the idea of a trip far more plausible.

It occurred to me that a number of the things mentioned, both here and elsewhere, are not necessarily as inconsistent as they may appear. The information is right there actually, in amongst the haystack.

  • 11) Berg is killed before torture photos released but video tape refers to photos?
  • 12) Text with video mentions "shameful pictures"
  • 28) Handling of papers on video
  • 29) Audio is dubbed: Tape of speaker and video are out of sync.
  • 38) Voice id

The captors are wearing ski-masks - we can't see their mouths.

In light of which, it's not beyond the realms of possibility that the "speech" that you hear is not necessarily the speech that you see. We don't know what the guy was saying, if anything at all. In light of which, it's quite possible that the voice on the tape is Al-Zarqawi's, but the guy supposedly making the speech isn't. This would clear up the whole timeline of "shameful pictures" inconsistencies. The tape has gone through heavy editing. It's quite possible that Berg was killed before the picture releases, and the message dubbed on post-hoc, in light of new information. I think it's also fairly evident that Berg was actually killed some time before the 'beheading'.

None of this, however, necessarily requires invoking western agencies.

Anyone with an eight year old PC and equally old software can edit video and sound reasonably enough to produce a tape like this. Anyone can re-edit something to suit their purpose. Why does it have to be a western conspiracy, and not just Al Quaeda, manipulating whatever's at their disposal to their advantage?

There are fat, pale and bejewelled arabs.

In addition, if you've ever shot video indoors, you'd know that getting the colour balance looking even part-way realistic is nigh-on impossible, especially when shooting under fluorescent lights, even more so when subsequently compressed to 'web video' formats. It's quite easy for even black skin to look somewhat 'pasty' under these circumstances.

I'm not saying there's nothing suspicious going on here, but an awful lot can be explained in a fairly straightforward manner: It's important to place more scrutiny on those things that can't. The history and facts of Berg's custody would be much nearer the top of that list than the presence of a common plastic chair.

The group called "Arabs" includes people with white skin. I'm sorry you haven't head the opportunity travel to the lands of the Middle East, or you would have known that already.

The US State Department offered Nick Berg a plane ticket. This would have got him from Iraq to the USA. It was offered to him free of charge. This offer was made just before Nick Berg was kidnapped. Nick Berg turned the offer down.

If the US wanted Nick Berg dead, why did the US offer him the plane ticket?

The tape said that Zarqawi was responsible for the killing of Nick Berg. It did NOT say that Zarqawi was the one who actually cut Nick Berg's head off. Zarqawi may have ordered it while not being in the frame. Even if he were in the frame, he may have been wearing an artificial leg.

I like how the poster is saying this and that about how the decapitation does not look real. No, Einstein, it doesn't look like a Hollywood splatter flick. Have you ever seen a decapitation of a man in real life before this? Have you ever held a man as he died in your arms? Shut the hell up. You don't know jack about life and death.

You did a nice job with this article. The Berg-beheading video became available May 11, and over the next few days I read in different Internet articles and comments most of the 50 items you list, and now it is less than a week later (May 16) and this Berg story is already old. The Internet is truly a wonderful tool for personal enlightenment in terms of being able to see thru the endless lies of the USAn imperialists.

My own opinion about the Berg video, based on all that I have read and seen over the last few days, is that it was a creation of USAn military intelligence, and was most likely made right in Abu Ghraib prison just as others have suggested. As a forum comment I read two or three days ago suggested, the Berg killers were too squeamish to cut off his head while he was still alive (I couldn't do it, and I doubt the typical USAn torturer or Abu-Ghraib contract torturer could do it either), so they killed him probably with a lethal injection, and then shortly afterward -- before rigor mortis could set in -- they did the toppling of his lifeless body shown in the video, followed by the head cutting.

For those interested in a better idea of what is going on in Iraq, and for those who want to cut thru the disinformation bullshit from the USAn media, I recommend News from Iraq: War, politics, economy. Oh my God! In the past, when I've seen such a heaping pile of horse droppings, I've voted it down, but I just realized something valuable: If I never let idiots on the other side state their opinions, then, for all public appearances, we "Bushites" appear to be the only side with idiots.

Not that I think Bush is a moron, but he's certainly not telling the whole truth to the American public. I think he can get away with this more easily because he's a poor public speaker. I don't think it takes a genius to figure out what's going on.

At any rate, Nick Berg was not killed by our side, and none of your one-sided circumstantial evidence is convincing enough to change my mind. I'll tell you what, though. If I was convinced that this beheading was a U.S. sanctioned event, I'd vote for Kerry in the upcoming.

I usually scoff at these things, but the point about the orange jumpsuit is a good one.  Why on Earth was he wearing that orange prisoner jumpsuit?  A lot of the other points I can pretty easily write off, but it's not like the US military would arrest him, take his clothes, give him a jumpsuit and then let him go without giving him his clothes back.

I suppose it's possible that the Iraqi police could have done such a stupid thing (possibly if they got the jumpsuits for free from the US Army and wanted to keep Berg's clothes to sell on the black market?)  It doesn't seem very likely, but I suppose it makes a little bit of sense.

Are there any other explanations for the jumpsuit?

Routine political power and conspiracy: U.S. imperialism and the prison-military-industrial complex

I wanted to offer some social theory and historical reflections to frame the Berg post. But, the article was too long already. So here is a comment post with a few thoughts and some links for reading about these things:

The most utterly intense social forces -- a global complex of conflict, profit seeking and cultural contradictions -- inform the context of the Berg beheading. This context is the invasion of Iraq and the larger war against terrorism (seemingly derailed by the invasion) and still more generally the history of U.S. imperialism and neoliberal (lassez faire) economic globalization over the course of the 20th Century and on.

Relevant to the recent Abu Ghraib prison disaster, the first article below goes into some of the connections between the prison-industrial complex and the forces of neoliberal economic globalization. The second article below by Hersh shows that U.S. super-covert black ops "no rules" agents had influence in Abu Ghraib, through an overextension of Rumsfeld's effort to circumvent normal cumbersome institutionalized military channels, checks and balances.

A few more links below list instances of U.S. imperialism: on the 100 or so U.S. imperial adventures in the last 100 years. And those links have yet more links.

So. Our social worlds move through the interaction of many layers of institutional, informal and individual social actions -- some routine and some not. Many government actions are routine: balancing budgets, generating reports, delivering the mail. Some government actions are creative or transgressive: initiating cutting edge, even moral problematic scientific research or fighting a war of invasion. Some government interactions are an intense struggle for power: these interactions regularly unfold through networks and small groups -- often out of the public eye. Such private struggles when they unfold over time against opponents are sometimes called "conspiracies."

Conspiracies -- both elite planning and covert on the ground struggles -- can be thought of as one part of the way that power elites get things done. Conspiracy means: networking, action, agency of elites and their agents -- power and action. Thinking about this is not silly. But, we don't want to ignore how social structures and larger social forces shape the context of social action. That conspiracies and covert action exist doesn't mean that elites don't also make use of investing in the stock market and conventional warfare or owning news media and dictating how those are used. It just means that as needed, and regularly, some elites engage in, well, their own versions really nasty culture jamming and in fucking up people's shit who are in their way, in a few words: black ops, psy-ops, conintelpro, and assassinations.

Remember Iran-Contra in Nicaragua. Remember the coup against Allende in Argentina. Remember the hostage crisis in Iran that lost the election for Carter. Some sections of the most powerful in the U.S. was behind all those. There are dozens and dozens more examples (many not as severe). Now, U.S. covert forces are trying to overthrow Chavez in Venezuela. The formerly named School of the Americas in the U.S. state of Georgia trains operatives from Latin America in all sorts of covert war skills. The Berg video is mild compared to what the U.S. regularly sponsors and teaches.

Why protest this? We must. Stakes are too high now. Earth hangs in the balance. If the Bush cartel, hard-edged neocon imperialists and oil business elites, keep control of the U.S. government, the condition of what democracy and freedoms we have in the U.S. and in the world may degrade terribly. The environment will suffer, perhaps too many insults to recover, perhaps severe disasters. The consequences of not pointing out all this horrible shit and not working to undo it are dire. So, really please think: before you dismiss this short political ramble -- please consider reading the links below about what happens when the powerful push their envelopes.

The Bush cartel has broken many international treaties. The Bush cartel has disregarded international relations. The U.S. government, as the world's dominant and very active imperial military power, has committed many war crimes and wants to stay out of International Criminal Court. We actually need to mend all these treaties and join the ICC.

Abu Ghraib is only one reason for the U.S. to join the ICC. In the ICC, we would be less likely to allow another Abu Ghraib to happen. Abu Ghraib is only an aspect of a larger trend and history. In the process of prosecuting the war on Terror, the U.S. has been reversing human rights at home and lowering the bar on human rights abuses and military crimes abroad. Do we want to really continue in that direction? Do we want to not question the abuse of power? Some elites in the U.S. government have a very very strong economic and political interest in winning the military and public relations war in Iraq. And, they may cross many moral lines to do so. We need to question this? The issue of the systematic abuse of prisoners in the wars in Afghanistan and Iraq and the killing of many civilians is much more important on a utilitarian scale than the Berg killing. But, the Berg beheading was a media event that was aimed at manipulating global public opinion. If by terrorists, horrible. If it was manufactured by U.S. or Mossad black op agents, if we can find that out: We must try. We are only a week into this as a public issue. But, perhaps the hard evidence is not available. If so, then on to other issues and battles.

It would take a fair amount of research and writing work to connect the history psy-ops and covert media work into the situation in Iraq to larger social forces and then to point out how the Berg killing might possibly connect with black ops in Iraq, even around Abu Ghraib. There is also the Daniel Pearl beheading in Pakistan to consider. And there are the murders of 100s and 100s of Taliban prisoners and torture of Al Qaeda prisoners etc. and black ops in Afghanistan and the role of the CIA in the early formation of Al Qaeda and of the U.S. in the early support of Saddam Hussein. This all just gets mind boggling. The world is a very complex place. But there are lots of minds watching these issues these days -- as the stakes are high -- our survival. And we have the internet now. More research is needed on all this. No doubt someone will do that eventually. Not me anytime soon. Busy.

first, I agree who ever it was was either dead or fake.

second, if it was a fake or a stand in corps, then Nick Berg is probably still alive and being interrogated some where and since he is thought to be dead by the world, his captors can do with him as they wish (so they think).

was is a ploy by the white house or the military? who knows, when the bergs get the body back, I hoe they do a private DNA test on him to prove that the body is actually their son, notice, that the head was not found with the body.

it may be possible that Berg is an Israeli spy, they have been known to recruit US citizens (who was that dude they caught back in 96?)

perhaps, this was done as a way to make Berg be a "kite", an agent with no ties to the rest of the world, super spy kind of crap. who knows, all we know is that conspiracies will abound, especially if the body does not get identified.

They strike me as a good source for an Oliver Stone movie -- and that's not an insult in case you misunderstand me.  But when I think of conspiracies in Iraq, the whole idea of something centering around Nick Berg ignores the much more obvious conspiratorial action not yet taken place.  If "they" would go to the effort of staging a homicide of an American, why would they not bother to plant biological or chemical weapons in Iraq for inspectors or soldiers to magically discover?  

The fact that none of these weapons have been discovered have shown me that the Bush Administration has not stooped to planting evidence in Iraq yet, so it is pretty hard to believe that they would stoop even further to murdering American contractors there.  So I really don't think you've got a leg to stand on here -- but if some "evidence" turns up on the eve of the election, I'll revisit the whole situation.

I haven't seen the actual video, but what strikes me odd is that in the video stills, the terrorists are shown wearing ski masks.

How likely is that you can find ski masks in a warm country like Iraq?

Either the video is badly staged by the World Shadow Government, or the terrorists are more dangerous than we have previously expected.

If the video is genuine, it suggests that there is a massive underground ski mask distribution network that ships ski masks to countries where such supplies are not available through legitimate channels. I suspect the Iraq sports equipment stores don't regularly stock ski masks. And as everyone knows, ski masks are the Number One terrorist headgear. You can't go slaughtering innocent civilians without a ski mask! That's probably the first lesson the new terrorists learn at the Al-Quaida terrorist training camp!

We demand strict customs inspections and classifying ski masks as munitions and blocking their shipments to known terrorists states!

Berg was a freelancer. What exactly he was freelancing at, I don't know, but I suspect that it was not telecom. Berg may have wanted to play for Israel, but he was no spy, for the simple reason that he would have removed the israel stamp from his passport.

The sync problem comes from the video capture, where the video is transferred to the computer. The editing is also done on the computer POST async, which is why there is a bit of an odd sync issue.

The jumpsuit was put on him symbolically, to demonstrate the displeasure of the Iraqis with the treatment of the prisoners in kuwait and iraq. The head-cutters knew about the mistreatment of prisoners long before it was published in WESTERN papers, because they are LIVING in the damned country.

Countries like iraq have a sole manufacturer of chairs, and most cheap chaírs look exactly the same. Do you really think that the chairs in american prisons were flown in with cargo jets?

Many, many Iraqi prisoners have escaped from U.S custody. I find it likely that at least one of them would have escaped with his jumpsuit.

Israeli soldiers regularly sell their weapons to Palestinians and jordanians. The region is AWASH with Israeli weapons. No suprise there.

Iraqi men are fat. Being an insurgent does not imply having a training or running around. You stand around, plant a bomb and run away.

There is blood on the floor in the video. If you cut off the head of a man, blood DRIPs for a while, then stops quite quickly. How much blood do you think is in your head? Not much.

Israel has got an intellgence network that pays for tips from private informers. I suspect that Berg was doing this, in a very unprofessional manner. This is why he was detained and released.

This man was a spy. His work was probably responsible for hundreds of deaths.

It is not necessarily suspicious that Berg had family connections in Iraq. This is more a counter point. It would point to some of his curiosity to travel about the country. Though, who are his uncle's brother's connections is something to research.

5. Berg carried Koran and "anti-Semetic" literature.
"Officials have told the Daily News that Berg also aroused suspicion because he was an unescorted American carrying a copy of the Koran and what they called "anti-Semitic" literature. Berg, who is Jewish, also told friends that his passport contained an Israel visitor's stamp."

There are some very serious problems with the audio part of this.

The screaming seems very clearly to be dubbed. Why?

The screaming starts (4:31 - on my copy, not the time stamp) about 5 to 6 seconds before Berg is touched (4:36 on my copy) and he is turned to his side. He is just sitting there like a lump. His head doesn't move and his mouth doesn't appear to (though the tape is blurry) -- yet he is screaming.

One of the cameras has a time setting that starts with 13, the other with 2. The very beginning of the video has a timestamp start with "13", so it's not that there is just a long gap.

What happened is that the editor used the audio from the one that had a longer continuous stream and then cut in the video from the other camera, which was obviously stopped and started several times during the execution.

Beheading details and time inconsistencies (GROSS) (2.70 / 10) (#175)

Clearly there's a lot of questions about this story and video, conspiracy or not. Last week I went through and looked closely at all the timestamp changes and issues (points 25 and 26), you can read my analysis here . (I would probably have a more suspicious tone were I writing now.) If you look at the time jumps carefully enough, and if you take the poor tape quality (point 23) to represent poor equipment quality instead of Black Ops doctoring of good equipment, there is no real missing time in the video, so I don't see when the guy could have been killed if you think he was alive while the statement was read (point 18). (there is time for him to have been drugged and for a drug to take effect (point 17).) I can't speak to sound issues (points 27, 29) as I've never edited video and don't know what edits can reasonably be expected to do to sound, but the video can be analyzed on its own. (for the record tho, the scream didn't sound necessarily female to me either (point 31).)

There are some comments there about the beheading but I kept it general in that space out of respect for my readership (who have not shown a desire to hear about my experiences in person, so I assumed they didn't want to read it in my blog either :) Based on my experience in smaller animals (and so of course, YMMV), the lack of spurting blood or blood dripping from the head (point 16, 19) doesn't mean anything. Heads do not have a lot of blood, what they do have is all caught up in the brain mostly, and the decap took so long that alive or dead, clotting would go a long way towards keeping the blood in the head.

As for the trunk, the video quality is so bad that it is hard to see how much blood there really is or how fast it is flowing. The decapitations I did were clean and fast (a gullotine) and without spurting. The pressure is simply removed from the system too quickly (this based on comparisons of my experience with that of a pig farmer guy I know, who had experience of spurting with more superficial cuts). The video quality is too bad to tell where the initial cut is made, but it matters for this question. If they've done it before in any way--live, dead, animal, human, whatever--they will have known where to cut to quickly drain the system of pressure and minimize spurting (but why would you want to minimize it in this context? wouldn't it be that much more dramatic?).

The blood would ooze out of the trunk once the major vessels are cut. A lot less of the body's blood volume comes out than you'd think: in rats, only 1/4 to 1/3 comes out immediately, the rest you have to...encourage out (and even then you're lucky to get 2/3 or even 1/2 sometimes). Also I see a lot of variation between strains in blood volume, speed of clotting, and how much blood you get initially--which means there'd be a lot of variation in the human population too. (The fractions above are based on the best bleeders.) Human blood volume, the Internet tells me, is around 5L for a decent-sized guy. so figure maybe 1.5-2L would come out at all. And blood is very thick (thicker than water, heh heh) so it wouldn't be expected to spread out very much.

More on point 19. "speed"? How is this a speedy job? If you buy my analysis it takes them almost two minutes. If you only believe your own eyes it's ~40 seconds. (And if you listen to the "alla, hu akbar" you can hear that an initial burst of excitement died out as the job went on and on. If it were faked (point 29) wouldn't the dudes have been encouraged to shout the whole time? To me it sounds like a natural reaction of people who were pumped, but didn't know how long it would take and their energy ran out.) My analysis or your own eyes, either way, that's a pretty dull knife, and the trachea and spine would hurt the cutting power of even a sharp knife. Also, even if you have a gullotine, we're talking tissue with varying amounts of elasticity. Things poke out and retract, it's not like cutting a chicken breast. There's just not enough evidence in the tape to make this call.

WRT point 50--when I wrote my post initially, I didn't know the family hadn't seen the body! VERY suspicious, and as a Jew, doubly so; by law Jews need to be buried whole, and _someone_ would have wanted to check--the family, the funeral home, SOMEONE. (Remember hearing about the Hasids in Israel who go around picking up all the little bloody pieces after a suicide bombing?)

One last thing. At the end of some videos the head is placed on the jumpsuit. If there is NO bloodspot on the jumpsuit when it's removed, something is definitely fishy when judged by my experience. Does that video exist?

Yes, it certainly is possible that there is a massive US plot to demonize the terrorists by violently murdering one of its own citizens; but, if it ever came to light, there'd be a fucking revolution in the States, and all the top officials would be lynched and hung from the cherry trees in DC. The current administration has clearly shown they do not care about public opinion concerning this war, and would never take such a gamble just to convince some more people that muslims are bad.

Your evidence is highly circumstantial. Everything you mention does allow for the idea that this was set up by the US, but it's much more likely that the video was produced by actual terrorists who don't know how to edit film.

They don't bother to listen to NPR, read the newspaper, or even watch CNN, for heaven's sake, then they spout off like this.

1) Because he did. We don't know why he chose to travel around Iraq alone for sure, but that was his business.

2) Sadly, we don't know. We do know that Mr. Berg may not have entirely trusted the US government, for good reason or otherwise. Also, we do know that people say things like this in letters to their families all the time, and are not always serious about an immediate return. In short, there is enough doubt here as to the actual circumstances that no real conclusion can be drawn by anyone who hasn't already reached a conclusion anyway. Confirmation bias aside, this is meaningless.

3) First of all, I question whether this was the FBI, since they're not actually empowered to act in Iraq, but no matter who it was, so what? I imagine the government checks up on most or all US citizens wandering around Iraq without official support these days.

4) There is no vast right wing conspiracy, any more than there is a vast left wing conspiracy. Get over it. Free Republic is free to print whatever inflammatory nonsense they want, and so is Al Franken, and it doesn't mean anything. I'm not a doctor, I don't play one on TV, I have no actual beheading experience, I can't speak a word of arabic, I'm an athiest, - hell, I've only rarely worn ski masks for that matter. (This is my standard disclaimer on all my job applications .. it's a wonder I'm working!)

That said, that guy in the jumpsuit was clearly alive at the time of the killing. I've seen a few beheading videos in the past, and none of them were bloody at all.

I don't even see "wag the dog" action going on here. It's too far from the election, under too crappy an economy, with far too much else to worry about. When we find a stockpile of weapons in mid October thanks to an unnamed source, maybe I'll bite .. or at least entertain the idea.

You know what bugs me about this? I generally consider myself a liberal. I certainly lean MUCH further in that direction. However, I'd never say that out loud in real life .. mostly because you immediately get lumped in with chattle such as this.

The timing of the video if nothing else screams 'wag the dog'.

I refuse to take this story and this video at face value.  There's a great deal going on behind the scenes in Iraq, if for no other reason than to try and salvage Dubya's second term in office.  Pretty much the only way they're going to salvage his presidency is to turn the tide in the american's attitude toward the 'war' on (in?) Iraq.

That or just get Jeb to steal the next one as well.

Of course, he'll probably just declare martial law the last week in October if the polls don't start going his way.  Good thing I'm only a couple of miles from the border.

(This began as a response to Toulouse's comment, but got out of hand. I'm posting it toplevel.)

The article seems to make the implication that if something is amiss about the tape, the first reasonable assumption would be that the explanation for the inconsistencies is because of malicious interference by some U.S. governmental agency. This was, I think, a mistake on the part of the author. It puts a political spin on the article which is unwarranted and hurts the credibility of those parts of the article which are impartial observations. Furthermore it distorts the debate-- it offers persons the opportunity to attack the article's spin without touching its points, and thus give the impression they have somehow made a valid attack on its points as well. Also, it woke trhurler up.

However, the vague implication of some sort of western "conspiracy", while invalid as an assumption, has no bearing on the plain factual points stated in the article, which I would still consider important. And if there was a "conspiracy", well, just because it's a conspiracy doesn't mean it has to be "western". Even if the tape's faked, how do we know it wasn't faked by Iraqis?

Anyway, he important point here isn't that that the U.S. did something bad (though there's a nonzero possibility they did), the important point is that the story being pushed by the U.S. media currently is shaky, and little or no fact checking is going on. I'm not sure if this article was intended as an attack on anyone, but whether it was or not, this article either isn't or shouldn't have been an attack on the U.S. government. What you ought to be reading it as is an attack on the U.S. media.

The thing that bothers me about all of this is that the U.S. media has done a very poor journalistic job here. It seems to me that the media, eager to be first with the news, all pounced on this videotape when the available information was very poor, and then once slightly more accurate information came out made no effort to correct themselves, either to prevent themselves from looking bad ("if we update our information, that shows we had the information wrong before!") or just out of laziness. This is not anywhere near as bad as the fact that a man was murdered and had his head cut off on videotape, but it's still worth discussing. And at the very least, the U.S. military-political complex is using this killing as a PR tool. There is no question of that. The only questions are how reasonable they are in doing so (I'd say probably very), and to what degree they have distorted the facts released to the public on the subject in order to make this event more useful as a PR tool (I'd say probably at least a little).

Here is an entire range of possible explanations with varying levels of conspiracy and/or U.S. complicity, all of which are at least as valid as the "the U.S. did it" implication in the article. If you are unpleased by the spin of the article, please pretend one of the below possible alternate spins had been used instead.

  1. The tape is completely "legitimate" and is exactly what it says it is, and just happens to have been recorded from two camera angles. Bern didn't struggle because he was drugged. Mr. Zaraqawi is in the video and he's talking, he's just someone whose hand isn't facing the camera and/or he bought a new leg. Inconsistencies in released U.S. information is due to poor communication between departments and the fog of war. (This one is unlikely because: See the 50 points in this article, some of them still apply. More importantly, from looking at the international reaction to the four americans killed and mutilated in Fallujah, it should be obvious that a tape such as this one would be an incredible PR tool for the Americans. Would a terrorist cell really be so incognizant of the way these things work as to think this tape would work out in any way in their favor?)
  2. Same as point immediately above, but the perpetrators did some wierd and very shoddy editing to their video to make it more amenable to their purposes (i.e. cutting out the very graphic blood spurting, adding the "scream").
  3. Same as point immediately above, but the perpetrators for some reason of their own are trying to masquerade as Abu Masab Al-Zaraqawi (perhaps to give themselves "legitimacy"?) and claim to be him in the video, but aren't.
  4. Same as point immediately above, and the remaining inconsistencies (I.E. in released public information) is due to clerical errors by U.S. officials.
  5. Same as point immediately above, except U.S. officials were actually irresponsible in the handling of Bern's release. The U.S. was holding Bern for all those days for reasonable reasons (perhaps Bern wanted to be held for his own safety), but when his parents filed lawsuit in the U.S., the people holding him went "shit, we don't want to cause an incident" and just opened up his cell, went "you're free, get out" and turned him loose on the street. Local "Insurgents" or fundamentalists or whoever, seeing his orange jumpsuit and realizing they knew who he was (he had been floating around looking for work?), immediately jumped on the guy and did Horrible Things to him. After the video of the Horrible Things got out, the coalition people who had been holding Bern went "oh, crap, we shouldn't have let him out the way we did" and immediately started trying to cover up and/or confuse the nature of Bern's release in hopes that U.S. media, shocked and horrified by the video, wouldn't dig too deep and there would be no consequences. (This is the one I'd consider most likely.)
  6. Same as point immediately above, except U.S. forces, in an elaborate and incredibly unlikely scheme, were not just neglegent in Bern's release but essentially nabbed Bern out of the prison and handed him over to a known "insurgent" group in a way that made the group think they were capturing him, in hopes the group would then do something horrible to Bern that would allow coaliltion forces to then step in and break the group up.
  7. The tape is completely "legitimate" and is what it claims to be, but was not intended by its creators for public release. The perpetrators intended it as a video to distribute amongst themselves, and/or as a trophy. A copy of the video happened to pass into the hands of some U.S. intelligence agency, which was unfortunately unable to confer the information they had relevant to this case to the more "above ground" American authorities because doing so might have compromised their source. However, once it became clear the Alu Jahib [sic?] scandal was not going to dissipate on its own, they chose to release the video anonymously because (1) it would be useful for overall U.S. purposes and (2) they knew the form of the release would not compromise their source. Powell complains about "lack of outrage" while the Tehran Times makes themselves look bad by claiming the video to be a fake, et cetera.
  8. The tape was mostly fabricated, but by Islamic fundamentalist sources. The U.S. released Berg on his own wishes and he was then killed by some local means (an Islamic fundamentalist group seized and killed him because he was Jewish, or he crossed some local burgeoning organized crime group before the U.S. took him into custody and they pounced him once he got out). Then, for some reason, after he was dead (thus no blood spurting), they sawed off his head on videotape. An unrelated Islamic fundamentalist/Iraqi "nationalist" group somehow got hold of this tape and erroneously thought "hey, this could be a great PR tool!", so they fabricated the overdubs and released it.
  9. Same as point immediately above, except the people who cut off his head weren't the people who killed him. Berg was killed by whatever purposes, then some sort of Iraqi "nationalist" group found his corpse, went "hey, we know this guy, he was poking around a couple weeks ago", so they staged a video in which they sawed the head off his corpse to make it appear as if they had captured him and killed him by decapitation, then overdubbed with a scream and someone claiming to be Zaraqawi.
  10. Same as point immediately above, except the people who found the corpse and made the tape weren't Iraqi "nationalist" "insurgents", they were local pro-U.S. Iraqis who are sick of their leaders being bombed and hoped this video would discredit the "insurgents".
  11. Same as point immediately above, except the people who found the corpse are some completely unrelated third group (Organized crime? Maybe even the people who killed him? Maybe Bern was killed for reasons not relivant to the War on Iraq, and the people who killed him fabricated the video so whoever's serving as "police" locally would assume "insurgents" did it and not come looking for the real killers? Or maybe this was just Mossad's very elaborate way of telling one of their informers "you're fired"?).
  12. Same as point immediately above, except the people who found the corpse and made the video were some U.S. government agency.
  13. Bern was somehow accidentally killed while in U.S. custody. Once he died, the prison guards or operators, having caught wind that the operators of the Al Jahib (sic?) prison fiasco were facing court marshall and fearing a court marshall of their own, went "oh hell, we're going to hang for this" then quickly fabricated and dubbed a shoddy video in which they claim to be an "insurgent" group killing Bern and cut the head off the corpse. Then when people asked what happened to Bern, they just said "oh, we released him two nights ago on his own wishes". (Let's call this the "Weekend at Bernie's" theory.)
  14. Same as above, only it wasn't an accidental death, rather Bern actually managed to escape the prison in some sort of jailbreak. A sniper stationed on the roof and working for the Prison saw someone in an orange jumpsuit running away and, thinking "oh no, a prisoner is escaping", shot him. Then once they went to retrieve the corpse they went "Fuck, this is an American, we're going to get in trouble for shooting him" and etc.
  15. Bern was killed by Iraqi "insurgents" or other locals and buried in a shallow grave somewhere. Some U.S. intelligence agency found out about this, but couldn't act in response because they didn't want to compromise their source. But they still wanted to use it as P.R. somehow, so they took a videotape they just happened to have sitting around of some guy getting beheaded-- possibly a tape that was years and years old and actually recorded in some other country, or was taken from the Republican Army archive-- and overdubbed it to make it seem that these events were being done by the "insurgent" group to Bern.
  16. The CIA fabricated this entirely from whole cloth. (This one is unlikely because: The CIA seems to vastly prefer that killings performed themselves are much more clinical than this one. I think even they'd balk at killing a man to saw off his head as a PR tool, especially when much more effective PR tools would be easy to manufacture in a less grisly manner. More importantly, at least some of the items in this list would almost certainly not have been there if this had been done entirely by the Americans. The CIA has at least a little bit of competence and anyone producing a fake from scratch would have created a more believable fake. At least something here is real.)

32) Mistranslation of Al Qaeda connection On the first day of Nick Berg's execution, it was reported on several major news networks that al Qaeda was connected to the killer's statement, which turned out to be false. The US Intelligence translation still retains this "reference" to al Qaeda, which does not exist. The U.S. government translation of one statement made on the film is: "Does al Qaeda need any further excuses?" This is a falsification. The actual statement urged fellow insurgents to get off their hind ends and do something. One assumes the translator used by the US military is a native speaker of Arabic, so this may not be an innocent flub. Did the US government intentionally link an alleged al Qaeda group into the murder of Nick Berg? Note: the word on tape was al qaed, with quite a different meaning from al Qaeda.
Al Qaeda is refered to in the west as an organization, with a boss and a heirarchy. This is probably done to put a face on the enemy. However, I recall reading in Foreign Policy that Al Qaeda is more of a movement - an ideology. The organization that Bin Ladin built is assuredly an important part of this movement - however, Bin Ladin's organization is not Al Qaeda in it's entirety, in the same way that Martin Luther King and his followers were not the Black Liberation movement in it's entirety.

Here is a new discovery about the Berg-beheading video, given in the article: Berg decapitation video was filmed inside the Abu Ghraib prison. Specifically, see item 4 near the bottom of the article, which says:

The most telling evidence that the video of the decapitation of Nicholas Berg was taken inside the Abu Ghraib prison can only be detected by performing a frame by frame analysis. La Voz de Aztlan did just that and some revealing frames came up that are difficult to see if the video is played on normal speed. Towards the end of the video, at frames 9306 through 9368, a person with a US military cap temporarily pokes about a quarter of his left head into the video. His neck, left ear and part of his cap and visor can be seen. We have prepared an animated gif with just the relevant frames that clearly shows this at Animated Photo 7. Look at the right hand side as someone with a military cap, possibly with a second video camera, pokes his head into the video. Compare this animated gif with the MP whose cap is circled on Photo 4.

After I read this, I had to see for myself, and sure enough it is there on the video, at video-time 13:46:25 (the time is shown in the lower-right corner of the video). The back of someone's head moves into the video's view on the lower-right side of the video for just a fraction of a second, and this head's ear is very light-colored (white). Once again, another piece of evidence that this video was made by light-skinned people (such as most Americans), and not by the on-average darker-colored Iraqis.

I certainly didn't notice this brief appearance of the back of someone's head when I watched the video days ago. And apparently no one else did. Good work by those who did the frame-by-frame analysis.

As an aside, the above-quoted article has one mistake when it says elsewhere "at least three of them are wearing bullet proof vests" (referring to the five men standing behind Berg), because those vests are not bullet-proof vests but instead are vests with pockets for holding AK-47 magazines. This error about the vests is also made in some of the other articles I have seen on this Berg-beheading subject, and this error has also been corrected by various posters in some of the other forums dealing with this subject. Note that I have seen photos of Iraqi Resistance fighters wearing these vests, and I assume the vests were standard issue in the Iraqi army.

Speaking of photos, here is a nice collection of photos showing destroyed and burning American war materiel, which was destroyed about two weeks ago by Al-Sadr's forces in southern Iraq: Resistance and the Iraqi street. Notice how jubilant the Iraqi civilians are. Obviously, the Iraqi Resistance has the support of the population.

And for those who don't know, the rocket-propelled grenades (RPGs) that the Iraqi Resistance use, can punch thru a foot of armor. These RPGs are destroying everything (APCs, armored Humvees, Bradleys) including those Abrams tanks that the American media always talk about as if they are invincible.

right? Based on a novel? I understand that, because of its plot, it's a useful reference for conspiracy-minded folk. But it's not another "fishy circumstance"; it's your premise. Let me help your argument: This is all very Star Trek, the salt vampire episode. Ironically, the first uses of "Wag the Dog" in this context was Clinton's cruise missile attack on Afghanistan and bombing of Iraq in 1998. The cries were coming from the other side of the aisle.

Thanks to tiger for posting a link to these photos of jubilant Iraqis (well, supposedly they're Iraqis) celebrating around burning wreckage of US vehicles (see another video item discovered).

OMFG! Second photo down! Look at that arm! It's white! And those clapping hands and arms! Also clearly white! This is a creation of the CIA!

Picture below that. Damn that guy looks fit; not emaciated. So Iraqis can be emaciated or fit, but not fat. Any Iraqi who looks fat (underneath bullet proof vests and loose clothing) is an agent of the USA.

Seventh picture down. Another white guy, probably from Arkansas. His face is strategically turned from the camera so we can't see the results of $10,000 worth of American orthidonture while growing up. Like all these photos, this one was created by the CIA to make the US people think Iraqis are barbarians, celebrating at the death and destruction of US soldiers and equipment.

Ninth picture. What you would think was an overweight Iraqi, if you were an idiot. But we're not idiots. Clearly an American in disguise. Probably a computer geek, since they're slovenly.

This article would have been so much better if you had focused on the facts instead of the theories.  The facts are fascinating1.  But you present them under an assumption that most will, frankly, reject outright based on emotion.  The rest of us will think about it and then dismiss it.  

The only things you have linking the video to the U.S. are the convenient timing for the administrative branch, and the government's mistakes and denials regarding Mr. Berg and the video.

al Qaeda doesn't want to end the occupation peacefully, they want to prolong it and make it bloodier.  It's great recruiting for them, and it weakens the U.S.  Why let the soldiers feel too much empathy, when you can remind them who they are supposed to hate?  Then they'll go out and do the job of making themselves hated.  Others in Iraq have surely figured this out as well.  The point is that Bush is hardly the only one to have potential gain from this.  And him not much at that, since people really do seem to be more shocked when their own country commits evil in the name of Freedom.

Though that wouldn't stop the CIA from jumping on the video.  Haven't you realized that the administration has a strict "don't ask, don't tell" policy regarding the quality of their intelligence, as long as it works for their side?  I wouldn't be surprised if they cried "al Qaeda!" without bothering a linguist first just to get the story in the news.

It'd be rather strange if they created the video and then mistranslated it, wouldn't it?

So what's really going on?  It sounds like the video does not show what it purports to.  The victim may have already been dead.  It may have been dubbed, by someone with more knowledge of Arabic than the CIA.  What does it really say, then?

Somewhere in my reading as a youngster, back before the first computer I ever saw (an IBM 1620 with a door on each end and a hallway down the middle, if you remember those), I read a description of a decapitation by cannonball from the US War Between the States, that described the blood spouting ten feet high -- along with a calculation from blood pressure and diameter of the major arteries in the neck that concluded this was a credible description.

And in the same year, I remember reading:  "Who could have believed the old man had so much blood in him." -- Shakespeare, Hamlet.

This is the thing that strikes me most as improbable.  But it's surprising how many things I _can't_ find with Google, like more about this question.

Once again, the researchers at La Voz de Aztlan have found something new on the Berg-beheading video. See their May 19, 2004 article: "How will it be done?" is heard in the Nicholas Berg decapitation video!.

Once again, as soon as I read this I had to hear it for myself on my copy of the video (filename: iraq2vediom.wmv; filesize: 5.4MB). It begins at just about video-time 13:46:28 (the time is shown in the lower-right corner of the video). At this time, one can hear a man's voice softly saying "How will it be done?".

Of course, I had already watched the video a number of times after I had read about the video and then downloaded the video a day or two after the video became available May 11, 2004. And needless to say, just like how I never noticed the brief appearance of the back of someone's head in the video (see my earlier comment #272), I never noticed this soft English-speaking voice. I do remember hearing this bit of audio when I watched the video, but it just sounded like something in the background that I did not recognize, so I just assumed it was some Arabic which presumably everyone in the video was speaking. And since while watching the video I was focused on the beheading shown on the video, I was not concerned nor focused on this brief audio event. This is one of those things that can very easily be missed, and obviously it was also missed by those who made this video, because if they had caught this they would have simply blanked out the video's soundtrack at that spot.

So holy shit! If there ever was a smoking gun for the Berg-beheading video, this is it. With this latest revelation, there can be no doubt. The Berg-beheading video is a creation of the Americans. The guy one can hear saying "How will it be done?" sounds like an American. I am an American myself so I know how we sound. His voice did not have any noticeable regional accent like a Southern accent or a Boston accent. Instead, he sounds like how I sound, and like how most people on American TV sound, in terms of not having a distinct regional accent.

For those who have the video, hear it for yourself!

I distinctly remember seeing humiliation / torture photos (particularly the one with the wires) on Aftonbladet and other news sites several days before Berg was killed.

I remember asking myself WHY IN THE FUCK would they send a Jewish reporter to Afghanistan.

Daniel Pearl must have been either incredibly brave or unbelievably stupid to go to Afghanistan. I was unaware that Mr. Berg was Jewish until today. I'm wondering what would possess a Jewish person to travel to any destination outside of Israel while in the middle east?

I'm black and I wouldn't dare of wandering around the hills of rural Idaho by myself.

Something about this strikes me as fishy as well.

American businessman Nicholas Berg's body was found on May 8 near a Baghdad overpass; a video of his supposed decapitation death by knife appeared on an alleged al-Qaeda-linked website (www.al-ansar.biz) on May 11. But according to what both a leading surgical authority and a noted forensic death expert separately told Asia Times Online, the video depicting the decapitation appears to have been staged.

"I certainly would need to be convinced it [the decapitation video] was authentic," Dr John Simpson, executive director for surgical affairs at the Royal Australasian College of Surgeons, said from New Zealand. Echoing Dr Simpson's criticism, when this journalist asked forensic death expert Jon Nordby, PhD and fellow of the American Board of Medicolegal Death Investigators, whether he believed the Berg decapitation video had been "staged", Nordby replied: "Yes, I think that's the best explanation of it."

Questions of when the video's footage was taken, and the time elapsed between the shooting of the video's segments, were raised by both experts, reflecting a portion of the broader and ongoing video controversy. Nordby, speaking to Asia Times Online from Washington state, noted: "We don't know how much time wasn't filmed," adding that "there's no way of knowing whether ... footage is contemporaneous with the footage that follows".

While the circumstances surrounding both the video and Nick Berg's last days have been the source of substantive speculation, both Simpson and Nordby perceived it as highly probable that Berg had died some time prior to his decapitation. A factor in this was an apparent lack of the "massive" arterial bleeding such an act initiates.

"I would have thought that all the people in the vicinity would have been covered in blood, in a matter of seconds ... if it was genuine," said Simpson. Notably, the act's perpetrators appeared far from so. And separately Nordby observed: "I think that by the time they're ... on his head, he's already dead."

Providing another basis for their findings, in the course of such an assault, an individual's autonomic nervous system would react, typically doing so strongly, with the body shaking and jerking accordingly. And while Nordby noted that "they rotated and moved the head", shifting vertebrae that should have initiated such actions, Simpson said he "certainly didn't perceive any movements at all" in response to such efforts.

During the period when Berg's captors filmed the decapitation sequence, circumstances indicate that he had already been dead "a quite uncertain length of time, but more than ... however long the beheading took", Simpson stated. Both Simpson and Nordby also noted the difficulty in providing analysis based on the video, the inherent limitations presented by this. But both also felt that Berg had seemed drugged.

A particularly significant point in the video sequence occurred as Berg's captors attacked him, bringing the supposedly fatal knife to bear. "The way that they pulled him over, they could have used a dummy at that point," reflected Simpson regarding what the video portrayed. Separately, Nordby said Berg does not "appear to register any sort of surprise or any change in his facial expression when he's grabbed and twisted over, and they start to bring this weapon into use".

Subsequently, Nordby said it was likely that the filming sequence was manipulated at the point immediately preceding this, allowing Berg's corpse to be used for the decapitation sequence. Nordby also emphasized that the video "raises more questions than it answers", with the most fundamental questions of "who are you, and how did you die", being impossible to answer from it. But broad speculation exists regarding a number of factors surrounding both Berg's death and the video, and its timing in regard to revelations of US prison atrocities.

In a May 13 article, the Arabic newsgroup Aljazeera reported that a Dubai-based Reuters journalist first broke the story, "but while Fox News, CNN and the BBC" were able to secure the video from the "Arabic-only website" that hosted it, Aljazeera was unable to locate it. And also on May 13, the Associated Press (AP) reported that the US Central Intelligence Agency had determined that Abu Musab al-Zarqawi was the individual who beheaded Berg.

Since Secretary of State Colin Powell's United Nations presentation of February 5, 2003, al-Zarqawi has been portrayed as the single most dangerous element facing the Bush administration's "war on terror". Powell's UN presentation has since been widely accepted as empty; nevertheless, al-Zarqawi appears to have surpassed even Osama bin Laden as the administration's No 1 terror target. And on May 15, Brigadier-General Mark Kimmitt, the Coalition Provisional Authority's chief Iraq military spokesman, declared that al-Zarqawi will be eventually caught, though that may prove particularly difficult.

On March 4, Brigadier-General David Rodriguez of the Joint Chiefs of staff revealed that the Pentagon didn't have "direct evidence of whether he's [al-Zarqawi] alive or dead", providing commentary on the nature of prior "evidence" linking al-Zarqawi to attacks and bombings. But that same day, AP reported that an Iraqi resistance group claimed al-Zarqawi had been killed the April prior in the US bombing of northern Iraq.

Speaking off the record, intelligence community sources have previously said they believe it "very likely" that al-Zarqawi is indeed long dead. Such a fact makes al-Zarqawi's alleged killing of Berg difficult to reconcile, and there has been broad speculation that blaming al-Zarqawi is an administration ploy. Further anomalies surrounding Berg's death have fueled added speculation.

According to e-mails sent from a US consular officer in Baghdad, Beth Payne, to the Berg family, Nick Berg was being held in Iraq "by the US military in Mosul". A May 13 AP report notes that a US State Department spokesperson subsequently said this was untrue, an error, and that Berg was being held by Iraqi authorities. But another May 13 AP report quoted "police chief Major-General Mohammed Khair al-Barhawi" as claiming that reports of Iraqi police having held Berg were "baseless".

And Berg is seen on the beheading videotape in what appears to be US military prison-issue clothing, sitting in what appears to be a US military-type white chair, virtually identical to those photographed as used at Abu Ghraib prison. However, the taking of hostages has occurred in the region, and beheadings are not unheard of.

According to a February 2003 report by Human Rights Watch (HRW), on September 23, 2001, radical Islamists captured a group of 25 Kurdish fighters in the Iraqi village of Kheli Hama. "Some prisoners' throats had been slit, while others had been beheaded," HRW reported, noting that the television station KurdSat had broadcast pictures of the dead that September 26. The report also noted that a videotape "apparently filmed" by those committing the atrocities had been found.

The strict Islamist community in Iraq denied that the acts were committed by their people, stating that the incident was fabricated.

Additional reports of beheadings also exist, with the victims usually noted as killed with a bullet before the beheading occurs. But HRW's report also raised an issue that the Berg video's makers, and Berg's father, both raised: prisoner exchange.

HRW noted that Iraq's radical Islamists did pursue exchanges of captives, and the Berg video specifically noted that his captors claimed they were killing him as their attempts to exchange Berg had been rebuffed by US authorities. Berg's father, Michael, has pressed the administration of US President George W Bush as regards what the facts of this allegation are, with the administration denying any knowledge that such a trade was offered. And added questions still exist.

Because Iraq's radical Islamists speak in a particular manner, and live by a closely proscribed code, apparent contradictions between these ways and the way Berg's captors appeared has generated speculation. Some observers have speculated on the possibility that the individuals weren't native Arabic speakers. Conversely, it is reported that in Saudi Arabia, where Sharia law allows for beheadings in cases of severe crimes, the condemned is heavily drugged with tranquilizers prior to the execution, reportedly leaving them in a state similar to that which Berg appeared in during parts of the video.

Again, Nordby emphasized that the video "raises more questions than it answers".

coincidental as the purported figure in the video doesn-t appear
handicapped. The US does not elaborate on which intelligence is wrong.

Even Colin Powell claimed that Zarqawi was fitted with a prosthetic leg in a Baghdad hospital

I send you my love, may humanity now learn how urgent Now is. --- I just saw the video of the slaying of Nick Berg. It is a sad and gruesome sight, but one which, very truly - sadly, the world *needs* to see. I say this because, in America specifically, we are far removed and withdrawn and sheltered from the New World within which we are now hostage. A world of war, terror and death. There is no honor, no noble cause, no value or benefit from the current situation the world has run into, eagerly without cognition. I just saw the video of the slaying of Nick Berg. It is a sad and gruesome sight, but one which, very truly - sadly, the world *needs* to see.

I say this because, in America specifically, we are far removed and withdrawn and sheltered from the New World within which we are now hostage. A world of war, terror and death. There is no honor, no noble cause, no value or benefit from the current situation the world has run into, eagerly without cognition.

We are in a time, Now, where we are propelling ourselves deeper into a manifestation of hellish experiences on Earth for many many people.

In the US - we have no idea of what the real situation is in Iraq. We do not see the urgency of the moment that the people of Iraq see second to second - the same urgency that the US Troops also see and live.

No longer can we hide behind the smug smile of the image of a president and his mighty army liberating a joyous and grateful people.

There is no high moral ground any longer - if there was any to begin with.

It is time to reclaim our Country, our Honor, and our Reality.

Please take a moment to realize that in the "Post 9-11" world what sacrifices you have made to address this "war on terror". Please take a moment to realize that in fact, you have likely spent very little time contemplating the grave importance of Freedom which is being stolen from all of Humanity, one bomb at a time. One DU round at a time. One law, one act, one lie and one cover-up at a time.

The war on terror is nothing about the protection of your freedom - it endangers your freedom, your family and your future. The war on terror is a war on your Life, Liberty and Pursuit of Happiness.

Please remember that Freedom, Life, Liberty and the Pursuit of Happiness does *not* mean now, nor has it ever in any point in history meant, the protection of consumerism and profiteering of large US, international or global companies and defense contractors.

Here is a method on how to begin to analyze the data of a substanive new news article on Berg (url below) and new articles and information in general.  

Below that some thoughts about the new article.  

Below that are some thoughts about interpretation.  

Method to organize new data (from multiple articles and sources now):

1. splice out the points
2. sort them by new and old
3. group versions of same data points
4.a. note if point is evaluated as valid and not valid/debunked.
4.b. synthesize versions of same points, taking best accounts
5. note as matter of fact (verified or not) or evaluation (strong or not or unknown source) or circumstance
6. separate out the disproved fact claims and weak evaluations.

Then interpreation/analysis of points needs to go on from here.  (see below on more)

Quick Evaluation of article.
I found the article very interesting for these reasons:

- it is the first article in the mainstream press presenting an extensive number of points about the Berg video

- the article presents a number of the points from blogs, but sanitizes them and refers to the points as being generally discussed.  So, there is a rhetorical framing going on here that makes the data seem -- more like data.  

- the rhetoric of the article interweaves the circumstantial points, expert points, points of fact and background cultural points with a seeming objectivity. But it is basically a subset of the data I gathered in the above article with a 5 or 10 more points (need to count them up).

Each of these points -- first public notice, data sanitization, rhetorical framing -- I think makes the article worth reading and taking apart. In time, I might do this.  No time now. Someone else, feel free.

Analysis steps.
Eventually, once the above is done on these and more new points, then perhaps one can start looking more closely at the patterns in the data -- and evaluating those a bit.  

Then one can see how the patterns fit together (western actors or not?, U.S. gov denials and contradictions, Berg's activities, etc.) but...  

There have been more and more hypotheses popping up so listing all of those potential patterns is a needed step, as was done in one comment string here (rated near top of comments).

I think to go into the above would take a fair amount of time.

... but.

I watched this thing again, as much as anything to see if I could spot the inconsistencies you mention, and I note many of them. I too see what appear to be muscle contractions, which may indeed simply be the "captors" manipulating Berg's limbs. On the other hand, of concern to me (and it's still as disturbing as the first time I saw this video) is Mr. Berg's head, gasping, after his larynx and carotid artery are severed.

This is disturbingly consistent with the decapitation of a living human being.

I do not doubt that the audio and video of this tape have been heavily edited, but I still think Mr. Berg -- or whoever this is -- was alive when the sawing began that severed the blood vessels to his head.

Bloodstain Analysis from Nick Berg Beheading Video - Forensic Irregularities Cast Doubt on Events

Introduction: My reaction to the horrific nature of the now infamous Nick Berg video overshadowed any consideration of performing any type of forensic bloodstain pattern analysis of the decapitation of this victim. Frankly, it appeared to be a rather open and shut case - a cold-blooded murder, an al Qaeda made-to-order "snuff film" where the victim was a 26 year-old American contractor working in Iraq. He was reportedly killed on Saturday, 8 May 2004 in a particularly gruesome manner - his throat was cut and he was decapitated. His body was reportedly found near a highway overpass in Baghdad, where his head was fully separated from his body. As the week progressed, analysts at the Northeast Intelligence Network found the absolutely revolting video posted on an al Qaeda linked website. The video was downloaded on 11 May 2004 for analysis.

As Laura Mansfield began her analysis of the footage, specifically the audio statement being read by the primary assailant identified as Abu Musab al-Zarqawi, I began to hear rumblings about oddities surrounding the footage. One of several "oddities" involved the blood evidence shown on the video. As I am certified in Bloodstain Pattern Analysis by the Laboratory of Forensic Science (Corning, New York, 10 May 2002) and a member of the International Association of Bloodstain Pattern Analysts-IABPA, I decided to take a closer look at the video. The following is my report that details my analysis of the bloodstain patterns only. It is important to note that this analysis is only a detailed summary of a more lengthy analysis; for the sake of brevity, some of the written commentary regarding each frame has been omitted.

Forensic Analysis of "Berg Decapitation Video"

Date: 13 May 2004

Overview: This investigator was furnished with two versions of an Internet video playable in a .wmv format which was downloaded from the al Ansar jihad website by Northeast Intelligence Network Analyst Laura Mansfield on 11 May 2003. The video was 5 minutes 37 seconds in length and was approximately 5.3 megabytes in size. Using an industry accepted method of capturing this video to a computer hard-drive, this investigator captured the entire file that would enable frame-by-frame analysis.

This investigator isolated the decapitation scene from the time initial physical contact was made by the individual holding the knife (but not close to the victim) through the final frame of the video. In total, approximately 460 individual frames were viewed, although only 330 frames were analyzed due their relevance to this analysis.

The victim depicted in this video appears to be a Caucasian male in his mid to late 20's, medium build, with dark hair and an untrimmed beard. No distinguishing or identifying marks on the victim were noted. He is shown in this video wearing an orange jumpsuit or similar style garment and was seated on the floor, legs out in front of him slightly bent at the knees and his hands were positioned or tied behind his back. His legs appeared to be bound at the ankles by rope or similar material.

Frame-by-frame analysis began at the following image.

Summary of Frame-by-frame Analysis

There is a time stamp noted in the bottom right corner of the video. The first frame displays the time in a military format beginning at 13:26:25 (1:26 PM). At that time, the victim was seated in a white or light colored chair as he was videotaped by an unknown individual. There is an apparent edit point or video stoppage where the time switches to 14:18:XX, at which time the victim continues to be seated in the same chair as previously described. The video then exhibits a stoppage or edit point, next showing the victim seated on the floor in front of a group of six masked and hooded individuals. Almost immediately upon this scene change, the time display in the lower right corner of the frame was switched from military to "regular" format (i.e. from 14:18:XX to 2:18:XX). Following this serried of frames, there appears to be another stoppage or edit point where the victim is still seated on the floor in front of the line of individuals, however the time displays 2:40:13 in regular format. The male in the center, standing directly behind the victim, is observed reading from sheets of standard size white paper.

The next remarkable event takes place at 2:43:XX, when (what appears to be) the first significant movement of the victim, where he appears to raise his shoulders and slightly adjusts his position. Noted in the next series of frames is the change of time from "regular format to military format, occurring at 14:44:14. Following this, the primary assailant, standing in the center background, removes a knife appearing to have an eight to ten inch blade from under his garments from his chest area with his right hand and swiftly places his left hand on top of the victims head, grabbing his hair. The victim was pushed onto his left side by the primary assailant and assisted by the unidentified individual wearing a white hood/mask combination (this male was originally standing on the right side of the primary assailant).

As the time displays 13:45:47 in the lower right corner, the victim is pushed onto his left side where his legs are bent at the knees and raised toward his chest and his arms still tied behind his back. At this point, the video becomes out of focus and essentially useless for the purposes of analysis from approximately 90 frames. As the video comes back into focus, the primary assailant is viewed using the knife to cut the throat of the victim, beginning at the area near his left carotid artery. Almost immediately, blood is seen "pouring" onto the floor (target surface) from the wound caused by the incision.

The primary assailant is shown using the knife in a slicing fashion, cutting the front of the victims neck (throat) first, followed by a combination of circular and sawing motions with the knife around the victims neck while still holding the victim by the hair.

Notably, there appears to be an edit point or video stoppage where the video displays 13:46:XX. At this point, it is evident that the primary assailant is no longer holding the knife. The individual wearing the white hood and previously standing on the right side of the primary assailant is now using the knife in a saw-like manner, holding the knife in (his) right hand while holding the victims hair with (his) left hand. At 13:47:xx, the individual wearing the white hood ultimately detaches the victim head from his body and holds the head outward in (his) left hand, still holding the knife in (his) right. Following this series of frames, the video appears to "jump frames" (possibly due to uploading the video to a computer) and displays the time as 13:48:43, at which time the victim's head is shown completely detached and the primary object in the footage. Interestingly, the time display on the video changes to 2:46:20 (regular time format) and then switches back to 13:48:45 (military format) while the victim's head is shown detached from his body in a similar series of frames.

Remarks:

This investigator notes the potential significance of the changes of the time formats, a feature usually performed from the "menu" function of most video cameras. As the camera and media type on which the video was recorded is not known, no further assessment relative to the format change can be made.
Most interesting in addition to the time-format change is the change of the time itself. Without going into frame-by-frame detail, it is interesting to note that the actual act of decapitation as displayed in this video appeared to have been recorded when the time displayed was between 13:45:XX and 13:47:XX. This is significant as the victim appeared in the video, seated on the floor in front of the assailants, at 2:40:13, or nearly one hour after the decapitation (based on the time display ONLY). This investigator has no method of determining if the time displays are accurate and has no background in video analysis.
The video is poor in terms of quality, yet still appears to be useful for the purpose of bloodstain pattern analysis.
Due to the known anomalies associated with converting the footage to computer compatible formats, the audio portion of the video was not taken into consideration.
Bloodstain Pattern Analysis

Based on this investigator's review of the video with specific focus on the series of frames that depict the actual act of cutting the victim and the consequential decapitation, there appear to be significant inconsistencies with the cutting and decapitation of the victim. Most significant is the lack of arterial spurting (or gushing), which normally occurs when the artery of a live human victim is breached or cut. This investigator has reviewed numerous crime scenes where an artery of a living person was breached, many by a sharp instrument. In every case, arterial spurting exhibited common characteristics and can best be described as follows:

"Unlike impact spatters and cast-offs, bloodstains resulting from damaged arteries are not dependent upon the criminal acts which precede them.

Those stains which are classed as arterial damage patterns, spurts and gushes, occur as a release of blood under pressure after the fact rather than from a direct assault... Once opened, arteries may continue spurting as long as the heart continues to pump and blood is available in the vessel. This means that arterial spurt patterns may be recorded on bystanders responding to the victim after an assailant is gone."

"It must be noted that arterial damage can project blood great distances."

Taking into account the definitions and characteristics of arterial rain, arterial fountain, arterial breach, arterial spurting and arterial gushing, and the obvious breaching or cutting of both carotid arteries of the victim while he was purportedly alive, one would expect to observe significantly more force behind the emission of blood from the victim's wounds to his throat. Even as the victim was lying in a horizontal position to the ultimate target surface (the floor), there was little, if any, evidence of arterial spurting or gushing. A cut or breached artery has the ability to project a substantial amount of blood a significant distance away from the victim. In many cases, the distance can be five feet or more. Another characteristic of arterial spurting is the familiar "W" pattern made by the blood under pressure. A typical depiction of arterial spurting is shown in the image below:

Although this pattern was made from blood spurting from a victim's artery onto a wall, the characteristics would normally be the same regardless of the target surface, only dependent upon the position of the victim. In the video reviewed by this investigator, the victim was nearly horizontal with the floor, although the upper portion of his body, especially his head and neck, were hyper-extended backward by the initial assailant. Based on the accepted forensics of bloodstain pattern analysis, this hyper-extension, combined with the cutting of both carotid arteries, should have produced a much more defined pattern than observed on this video. Although the video clearly illustrated evidence of significant pooling of blood directly below the victim's neck, it appeared to lack the force commonly associated with arterial spurting, gushing, or raining.

CONCLUSION: Based on the investigative analysis conducted, it is the professional assessment of this investigator that the blood pattern shown in the video is NOT consistent with the cutting or breaching of the carotid artery or arteries of a person where the victim's blood pressure would be considered to be within the normal range. Based on this observation alone, this investigator questions the authenticity of the video as it was been presented for bloodstain pattern analysis.

Arterial Spurting / Arterial Gushing: Characteristic bloodstain pattern on a target surface resulting from blood exiting under pressure from a breached artery. (these pattern are characterized by their size and shape).
